This seminar will provide an overview of the most fundamental aspects of commercial leases as well as the legal considerations which must be kept in mind by landlords and tenants alike. Focus will be given to protected commercial leases under Maltese law and the right to compensation, differences between di fermo and di rispetto periods, the process of evicting a defaulting tenant and conversely ensuring conformity with contractual and legal obligations as a tenant in defense of such claims. Reference will also be made to Maltese jurisprudence on such matters while further considering court decisions as they relate to mere delay clauses and differences between extraordinary and ordinary repairs.
This seminar will also feature a panel discussion which will offer practical insights, also giving participants the opportunity to ask questions on the subject.
